Terms of Service

These terms of service ("Terms") govern your use of the Aether website at aethergraph.io and the Aether API service ("Service"), operated by Aether ("we", "us", "our").

By accessing the website or using the API, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the Service.

1. What Aether provides

Aether is a product data API that aggregates and normalises product information from UK retailers. The Service provides structured data including product names, prices, availability, and purchase links through a REST API. Aether also provides documentation and related resources through the website.

Aether is an information service. We do not sell products, process transactions, or act as a retailer. When a user clicks a purchase link provided through the API, they are redirected to a third-party retailer's website. Any transaction that follows is between the user and that retailer, subject to the retailer's own terms and conditions.

2. API access and accounts

Registration

Access to the Aether API requires an API key, obtained through our developer registration process. You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your API key and for all activity that occurs under it.

API key security

You must not share your API key with third parties or embed it in publicly accessible code. If you believe your API key has been compromised, you must notify us immediately at hello@aethergraph.io. We reserve the right to revoke and reissue API keys where we suspect misuse.

Account termination

We may suspend or terminate your API access if you breach these Terms, exceed rate limits persistently, or use the Service in a way that we reasonably consider to be harmful to the Service or other users. Where possible, we will give you reasonable notice before terminating access, unless immediate action is required to prevent harm.

You may close your account and stop using the Service at any time by contacting us at hello@aethergraph.io.

3. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the API to build a service that competes directly with Aether by reselling the normalised data as a standalone product data API
  • Attempt to circumvent rate limits, authentication, or other technical restrictions
  • Use the Service to transmit malware, conduct denial-of-service attacks, or otherwise interfere with the Service's operation
  • Scrape, crawl, or systematically download data from the API beyond what is necessary for your application's normal operation
  • Misrepresent the source of data obtained through the Service (for example, by presenting Aether data as your own original research)
  • Use the Service in any way that violates applicable law or regulation

Using Aether data within your own application, agent, or tool - including presenting it to end users - is permitted and encouraged. That is what the Service is for.

4. Rate limits and fair use

API access is subject to rate limits that vary by tier. Current rate limits are published in the API documentation. We reserve the right to adjust rate limits with reasonable notice.

If you consistently exceed your rate limits, we may throttle your requests, contact you to discuss upgrading your tier, or suspend access if the overuse is causing service degradation for others.

5. Data accuracy and freshness

Aether aggregates product data from third-party retailer feeds. We take reasonable steps to ensure this data is accurate and current, but we cannot guarantee that all information is correct, complete, or up to date at all times.

Specifically:

  • Prices may change between the time Aether last checked and the time a user visits the retailer's website. The price shown by the retailer at the point of purchase is the definitive price.
  • Availability may change at any time. A product shown as "in stock" in the Aether API may no longer be available by the time a user attempts to purchase it.
  • Product information is sourced from retailer feeds and may contain errors or omissions originating from the retailer's own data.

Every API response includes freshness timestamps indicating when the data was last verified. These timestamps are provided to help you and your users assess data reliability. We encourage you to communicate data freshness to end users where appropriate.

Aether is not liable for decisions made based on data that has become stale or inaccurate after retrieval.

6. Affiliate links and commission

Aether earns revenue through affiliate commission. Every outbound purchase link provided through the API contains affiliate tracking parameters. When a user completes a purchase after clicking through one of these links, the retailer pays a commission to Aether through the relevant affiliate network.

You must not:

  • Modify, strip, or replace the affiliate tracking parameters in purchase URLs
  • Substitute your own affiliate tags for Aether's
  • Click purchase links systematically to generate fraudulent commission (click fraud)
  • Misrepresent the nature of the affiliate relationship to end users

You must ensure that the affiliate nature of purchase links is disclosed to end users in accordance with applicable law, including consumer protection regulations and advertising standards. The Affiliate Disclosure page provides language you may adapt for this purpose.

7. Intellectual property

Aether's IP

The Aether API design, schema, documentation, and website content are owned by Aether and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our documentation or website content without our written permission, except as necessary for the normal use of the Service (for example, referencing the API documentation while building an integration).

Your IP

You retain all rights to applications, agents, and tools that you build using the Aether API. Using the Service does not grant us any rights over your intellectual property.

Product data

The product data provided through the API originates from third-party retailers and affiliate networks. Your right to use this data is limited to displaying it within your application in connection with the purchase links provided. You may not bulk-download and republish the underlying data independently of the Service.

8. Availability and changes

We aim to provide a reliable service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our reasonable control.

We reserve the right to modify, suspend, or discontinue any part of the Service. For changes that materially affect API users, we will provide reasonable notice - typically at least 30 days for breaking API changes, communicated through the developer documentation and by email to registered users.

9. Limitation of liability

To the fullest extent permitted by law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Aether's total liability to you for any claims arising from or related to the Service shall not exceed the total fees paid by you to Aether in the 12 months preceding the claim, or £100, whichever is greater.
  • Aether shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded or limited by English law

These limitations apply whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis.

10. Indemnification

You agree to indemnify and hold Aether harmless from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any applicable law or regulation.

11. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer within the meaning of the Consumer Rights Act 2015, this clause does not affect any mandatory consumer protection rights you may have under the laws of your country of residence.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

13. Entire agreement

These Terms, together with the Privacy Policy and Affiliate Disclosure, constitute the entire agreement between you and Aether with respect to the Service. They supersede any prior agreements or understandings, whether written or oral.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. For significant changes affecting API users, we will notify registered users by email at least 30 days before the changes take effect.

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Service and contact us to close your account.
